This matter is before us on the petition of the appellee to transfer from the Court of Appeals, Third District, and appellants answer thereto urging denial of the petition for failure to raise a proper issue by the petition under Ind. R. Ap. P. 11(B) (2). Appellants answer correctly reflects that the petition fails to raise any of the grounds for transfer enumerated in the rule. Nevertheless, we regard the issue of the case as being of sufficient public importance to warrant our consideration, in view of conflicting decisions, and we grant transfer notwithstanding the aforementioned technical deficiency.
